SUSPECT CONVICTED AFTER DEADLY DRIVE-BY DOUBLE SHOOTING

26-year-old Xavier Underwood was convicted by a jury on September 24, 2021 in Charlotte NC. Xavier was the driver of the vehicle involved in a drive-by shooting that killed 30-year-old Tony Russell. 

In June 2016, Tony and a woman were walking along Tuckaseegee Road Charlotte, NC when a car pulled up alongside him, and two occupants, Jordan Ardrey and Zhaymalik Phillips, began firing. Xavier was driving the car.

Tony and the woman were both struck by the gunfire. Tony was pronounced deceased at the scene. The woman survived. 

Investigators spent months analyzing evidence and conducting interviews to solve the crime. In July 2021, Zhaymalik pled guilty to voluntary manslaughter. 

In August 2021, Jordan pled guilty to voluntary manslaughter.

Xavier was convicted for accessory after the fact to first-degree murder. The jury found him guilty as charged. A judge then sentenced Xavier to 59-83 months in prison.
