Esvin Hernandez, 30, was arrested on March 2, 2026 in Charlotte, NC charged with raping his female cousin.
In November 2025 the victim was living at Evin’s trailer park along with her 2 kids. The woman came home from work and had purchased Buzz Ballz alcohol for the adults to drink, as there was also another man living in the home.
The female victim put her kids to sleep and began drinking the Buzz Ballz with Esvin and the other man. The woman began to fell dizzy. She went into her room where she slept with her kids in the same bed. The woman also locked the bedroom door.
The woman began to feel like she could not move. She heard a tug at the bedroom door. She then began to record on her phone, it was dark so only audio could be heard.
A man is heard picking the lock to get in the bedroom door. The man enters the bedroom and the unzipping of a pants zipper is heard in the recording.
The man gets in the bed with the woman and her kids. The woman reports feeling a man’s private part entering her vaginal areas from the back.
Groaning is heard on the recording. After a few minutes, the man is heard leaving the bedroom. The woman wakes up the next morning and sees her phone recording which prompted her to go to police to report a rape.
She told cops what occurred and a sexual assault kit was performed on her. Cops called Esvin in for questioning, which he was not required to be present at without a warrant. Esvin denied that he raped his cousin.
Esvin agreed to provide his buccal swab to police, which he should not of done without a warrant. The swabs were put in an evidence envelope.
A man is accused of sexually assaulting a little girl on Christmas Day
The victim’s sexual assault kit returned in February 2026 and it showed that Esvin’s DNA was present on the victim’s vaginal external genitalia.
Esvin was arrested charged with rape and breaking and entering.
