MAN BEATS MURDER CHARGE, PROSECUTORS LOSE ON VALENTINES DAY, KISS GOODBYE

43-year-old Jose Augusto Diaz-Garcia was found not guilty of a murder that happened in Charlotte, NC. Jose beat the murder charge on February 14, 2022. Prosecutors always believe that the jury will side with them during murder cases, but things went in Jose’s favor in court. Jose was accused of murdering Froylan Turcios Perdomo, 24.

A Mecklenburg County jury found Augusto not guilty in the murder of Froylan.

The victim was shot and killed in March 2017 during an home invasion and robbery on Fishers Farm Lane Charlotte, NC at an apartment. Several kids were in the home at the time of the murder.

Perpetrators kicked in the apartment door and committed an armed robbery. Something prompted the culprits to shoot and kill Froylan. The victim was pronounced dead on scene.

The Mecklenburg County District Attorney’s Homicide Team tried Jose for first degree murder, three counts of robbery with a dangerous weapon, and conspiracy to commit robbery with a dangerous weapon.

On February 14, 2022, the jury found Augusto guilty of conspiracy to commit robbery with a dangerous weapon. The jury found Augusto not guilty of first degree murder and the robbery with a dangerous weapon charges.

A judge then sentenced Augusto to 23-40 months in prison. Charges against Augusto’s co-defendant, Carlos Rosales remain pending.
