MALE INMATE AWARDED $150,000 AFTER BEING SEXUALLY ASSAULTED BY GUARD IN JAIL CELL

Sexual acts went on in Haleem’s jail cell, the inmate sought $1 million, but judge gave him much less. The guard also had sexual violations in prison as an inmate himself

Haleem Gilliland, 25, was awarded $150,000 in November 2024 after being sexually assaulted by a jail guard in the Mecklenburg County Jail in Charlotte, NC. The jail guard is identified as Kyle Harris, 32. Haleem was an inmate at the jail. Follow Charlotte Alerts on Instagram.

Kyle went into Haleem’s jail cell in 2021 on multiple occasions and had sexual relations with him.

Jail staff became aware of the homosexual encounters on May 20, 2021, and an investigation was launched. Haleem raised claims that he was sexually assaulted inside the jail.

Haleem was identified by the jail as a male inmate. Evidence was collected and Kyle was identified as a suspect. Kyle was arrested and charged with multiple sexual offenses by a jail guard. Kyle was also fired from the jail. In September 2022 Kyle pled guilty to sexually assaulting Haleem.

Conditions at the Mecklenburg County jail were ruled unsafe by state officials

After Kyle pled guilty, he was sentenced to 4 years in prison, Kyle must also register as a sex offender for 30 years. In August 2023 Kyle got a prison infraction, he allegedly was performing a sexual act in prison with other inmates. Kyle’s projected release date is in 2026.

In 2023 Haleem filed a $1 million lawsuit against Sheriff Garry Mcfadden and the jail claiming gross negligence and civil rights violations under 42 U.S.C. Section 1983.

Haleem argued the $1 million was necessary due to PTSD, antidepressants, and counseling he needed after he was sexually assaulted in his jail cell by the guard.

Right wing federal Judge Frank Whitney lowered Haleem’s judgment to $150,000 saying,

“the $1 million sought does not comport with the amount of compensatory damages awarded in similar cases.”

Judge Whitney found that $150,000 was appropriate for compensatory damages.
